1. Preamble

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the TAMA Cookies website, operated by the company TAMA, a simplified joint-stock company (SAS) with capital of €5,000, registered in the Trade and Companies Register under SIRET number 930 470 299 00015, whose head office is located at 10 chemin de la buissonnerie, 78610 Les Bréviaires, France.

By placing an order on the TAMA Cookies website, the buyer accepts these General Terms and Conditions without reservation.

2. Products

The products offered for sale by TAMA Cookies are cookies. The essential characteristics of the products are described on the TAMA Cookies website. The photographs of the products are provided for information purposes only and have no contractual value.

TAMA Cookies is committed to providing products that comply with current French legislation and the standards applicable in France.

3. Price

Product prices are indicated in euros, all taxes included (TTC), excluding delivery costs. Delivery costs are specified at the time of ordering and depend on the delivery address.

TAMA Cookies reserves the right to modify product prices at any time, but undertakes to apply the prices in effect at the time the buyer validates the order.

4. Order

The buyer places an order online via the TAMA Cookies website. Validation of the order implies acceptance of these General Terms and Conditions.

Any order placed on the TAMA Cookies website constitutes a sales contract between the buyer and TAMA Cookies, subject to product availability. An order confirmation is sent by email to the buyer after payment validation.

5. Availability of products

Products are offered within the limits of available stocks. In the event of unavailability of a product after validation of the order, TAMA Cookies undertakes to inform the buyer as soon as possible. The buyer will then be able to choose between a refund of the unavailable product or a replacement with an equivalent product.

6. Payment

Payment for orders is made online, by credit card, via a secure payment platform. The order is considered effective after confirmation of the agreement of the bank payment centers.

TAMA Cookies cannot be held responsible in the event of fraudulent use of the payment methods used by the buyer.

7. Delivery

The products are delivered to the address indicated by the buyer when ordering. TAMA Cookies undertakes to ship orders within the timeframes indicated on the site, subject to product availability.

Delivery times are given as an indication and do not constitute a commitment on the part of TAMA Cookies. In the event of a delay in delivery, the buyer will be informed and may cancel the order if the delivery time exceeds 30 days. The buyer will then be reimbursed within 14 days following the cancellation.

8. Receipt of products

The buyer is required to check the condition of the products upon receipt. Any anomaly concerning the delivery (missing product, damaged, etc.) must be reported by the buyer to the carrier and to TAMA Cookies within 48 hours. After this period, no claims will be accepted.

9. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the buyer does not have the right of withdrawal for perishable products such as food products. However, in the event of a problem with the order (error, damaged product), the buyer is invited to contact TAMA Cookies customer service within 48 hours of receiving the order.

10. Warranty and liability

The products supplied by TAMA Cookies benefit from the legal guarantee of conformity and the guarantee of hidden defects, in accordance with the legal provisions in force.

TAMA Cookies' liability is limited to the amount of the order. TAMA Cookies cannot be held liable for indirect damages that may arise from the purchase of the products, in particular loss of business, loss of profit, loss of opportunity, damages or costs.

11. Intellectual Property

All elements of the TAMA Cookies website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of TAMA Cookies.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written authorization of TAMA Cookies.

12. Personal data

The information collected by TAMA Cookies when the buyer places an order is necessary for the management of the order. It may be transmitted to TAMA Cookies partners involved in the execution of the order.

In accordance with the Data Protection Act of 6 January 1978, amended by the General Data Protection Regulation (GDPR) of 27 April 2016, the buyer has the right to access, rectify, oppose and delete personal data concerning him/her. 13. Disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing this, the French courts will have sole jurisdiction to hear the dispute.
